These Terms of Service outline the agreement between Free Digital and clients who use our website, hosting, and related services. By applying for or using our services, you agree to the terms below.
1. Service Overview
Free Digital provides a free website design and setup service for Australian businesses. Customers pay a monthly hosting fee to maintain their website, which includes support, management, and technical upkeep.
2. Hosting Agreement
- The monthly hosting fee is $39, billed in advance.
- Hosting includes business email setup, SEO maintenance, technical support, and backups.
- A minimum 12-month hosting period applies to all free website builds.
- After the first 12 months, clients are free to migrate their website to another provider if they wish.
3. Ownership
All website content, design, and domain names remain the property of the client, provided hosting fees are up to date. Free Digital retains rights to any proprietary tools or software used in the website’s creation.
4. Payments and Cancellations
- Hosting is billed monthly and must be kept current to ensure continued service.
- Late or missed payments may result in temporary suspension of your website and email accounts.
- You may cancel hosting any time after the 12-month minimum period by providing notice via email.
5. Content and Use
Clients are responsible for ensuring that all text, images, and files provided are lawful and do not infringe the rights of others.
Free Digital reserves the right to remove or disable any content that breaches Australian law or our service standards.
6. Support and Maintenance
Hosting includes ongoing updates, backups, and minor content changes. Additional services such as redesigns, marketing, or advanced features are available as optional upgrades.
7. Liability
While every effort is made to ensure uptime and reliability, Free Digital is not liable for any loss of data, income, or business arising from downtime, external attacks, or service interruptions beyond our control.
8. Changes to Terms
Free Digital may update these Terms of Service from time to time. The most recent version will always be available on our website, with the effective date noted at the top of this page.
9. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be handled under the jurisdiction of Queensland courts.
